PRIVACY STATEMENT FOR THE CHILDREN'S DISCOVERY PORTAL
The Canadian National Institute for the Blind ("CNIB") is committed to
preserving and safeguarding your right to privacy. As part of this commitment,
CNIB wants our client users ("Users") and their parent(s) and legal guardian(s)
to be fully aware of what happens to the personal information which CNIB has in
its possession. This Privacy Policy sets out the manner in which we will
collect, use, disclose and otherwise manage the personal information of Users
of the CNIB's Children's Discovery Portal, accessible at www.cnibkids.ca
("Children's Discovery Portal").
Collection of Personal Information
We collect personal information when a User:
To register as a member of the Children's Discovery Portal, CNIB collects a User's name, e-mail address, and unique screen name, as well as the name, address and contact information of your parents or legal guardian. In addition, we collect User responses to our on-line votes and surveys and any comments, suggestions and other feedback Users provide. CNIB also collects User submissions to on-line chat rooms and bulletin boards and for certain of our interactive games. In addition, when a member sends an e-mail message to the CNIB through the Children's Discovery Portal the time the message was sent, and the IP address from which it was sent is automatically collected.
CNIB may also automatically collect general anonymous information related to the use of the Children's Discovery Portal, such as the date and time Users visit the website and the pages visited on the website. In addition, CNIB collects "cookie" information from your browser to identify your computer and provide us with a record of your visits. The technology used to gather "cookie" information is provided by the Internet browser you use, and may be turned off by using your browser preference buttons (collectively, "Usage Data").
Use of Personal Information
The personal information Users provide us to register as a member of the Children's Discovery Portal is used to identify Users and to administer their participation in our polls, surveys or other interactive features. User screen names help us ensure User anonymity when visiting the Children's Discovery Portal, and participating in on-line chats, polls or other interactive activities.
CNIB may sometimes use the email addresses and phone numbers of Users (and/or of their parent(s) or legal guardian(s)) to provide them with notices about new services and features on the Children's Discovery Portal, to resolve problems with the Children's Discovery Portal services, to investigate activity that may violate the Terms of Use and to enhance the capabilities of our internal security systems.
The contact information of Users and their parent(s) and/or legal guardian(s) may be used to contact the member and/or the member's parent(s) and/or legal guardian(s) when necessary for chat room disciplinary notices and reports. These notices may include changes in our policies, chat room behaviour reports, and disciplinary action notices.
CNIB uses the Usage Data and feedback information to help understand how the Children's Discovery Portal is used (e.g., which pages or sections are most popular and when the peak activity times are), and assists in planning for future improvements to the site to better meet Users' needs.
Disclosure of Personal Information
CNIB does not sell, rent or otherwise disclose any personal information about Users or their parents and/or legal guardian(s) to any third party.
CNIB may on occasion run contests on the Children's Discovery Portal in which we give the opportunity for Users to enter the contest. In all cases, a privacy statement will be posted disclosing how any personally identifiable information collected from the contest participants in any such contest will be used by all parties involved. In all cases, when a User is asked to register for a contest we require the consent of the child User's parent(s) and/or legal guardian(s).
CNIB may from time to time share anonymous aggregated demographic information and Usage Data with various third parties, such as our service providers. This is not linked to any information that can identify Users.
Security of Personal Information
CNIB will maintain the personal information in our possession in appropriately secure data storage to safeguard it from unauthorized access, use or disclosure. CNIB will maintain the strict confidentiality of all personal information collected, and will only disclose such information to employees and contractors of CNIB who require such information for the purposes set out above. CNIB will only keep your personal information for as long as it remains necessary or relevant for the purposes stated above or as otherwise required by law.

TERMS OF USE FOR THE CHILDREN'S DISCOVERY PORTAL

The Canadian National Institute for the Blind ("CNIB") welcomes you to the CNIB's Children's Discovery Portal accessible at http://www.cnibkids.ca ("Children's Discovery Portal"). Please read the following terms of use (the "Terms of Use") before using the Children's Discovery Portal. By accessing and using the Children's Discovery Portal you signify your consent to these Terms of Use. If you do not agree to these Terms of Use, please do not use this Children's Discovery Portal.
OWNERSHIP / RESTRICTIONS ON USE
The Children's Discovery Portal is owned and operated by the CNIB. Any and all content, data, graphics, photographs, images, audio, video, software, trademarks, service marks, trade names and other information (collectively the "Content") contained in this Children's Discovery Portal are proprietary to CNIB, its affiliates and/or third party licensors. The Content is protected by Canadian and international copyright and trademark laws.
CNIB has created this Children's Discovery Portal for your personal use and enjoyment. Except as set forth herein, you may not modify, copy, reproduce, publish, post, transmit, distribute, display, perform, create derivative works from, transfer or sell any Content without the prior written consent of CNIB. You may print and download portions of the Content for your own non-commercial use provided you agree to maintain any and all copyright or other proprietary notices contained in such Content. Reproduction of the Content, in whole or in part, for commercial use, resale or distribution is strictly prohibited except with the prior written permission of CNIB. To obtain written consent for such reproduction, please contact kids@cnib.ca.
SUBMISSIONS
The Content submission areas (articles, reviews, polls) and the Communication Features (chat, bulletin board) on this Children's Discovery Portal provide users with an opportunity to post and exchange information, ideas and opinions (the "Postings".) Please be advised that should you submit any Postings, they shall be deemed to be non-confidential and attributable only to screen names. Postings do not reflect the views of CNIB. In no event shall CNIB assume or have any responsibility or liability for any Posting or any claims, damages or losses resulting from their use and/or appearance on this Children's Discovery Portal. By submitting any materials to CNIB and/or the Children's Discovery Portal, you (and your parents) irrevocably waive your moral rights in such submission to CNIB and automatically grant to CNIB a perpetual, royalty-free, world-wide, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials or incorporate such materials into any form, medium, or technology (now known or hereafter developed or devised).
RULES FOR POSTING
Users agree that they will not submit any Postings that:
(a) Are inappropriate for the CNIB Children's audience. This includes, but is not limited to, submissions that are derogatory, discriminatory, obscene, pornographic, threatening, or harassing. This also includes any communication that constitutes a criminal offence, gives rise to civil liability, or otherwise violates any applicable federal, provincial, territorial or other law or regulation;
(b) Include any personal identifiable information of the user or anyone else;
(c) Are for commercial purposes or contain advertising or are intended to solicit a person to buy or sell services or to make donations; or
(d) Are for the purpose of spamming.
Users specifically acknowledge that soliciting other CNIB Children's Discovery Portal users to join or become users of any commercial online service or other organization or group (profit, non-profit, religious, social, political, or otherwise) is expressly prohibited.
CHAT RULES
It is important to understand the basic safety rules before chatting. Users are required to follow the following chat rules for the enjoyment and safety of all users.
Users understand and agree that CNIB may suspend or terminate their access or use of the Children's Discovery Portal without prior notice if they engage in conduct that CNIB believes, in its sole discretion, violates any term or provision of these Terms of Use, including, without limitation, the Rules for Posting or the Chat Rules otherwise violates the rights of the CNIB or third parties or is otherwise inappropriate for continued access and use of the Children's Discovery Portal.
PRIVACY
CNIB is committed to preserving and safeguarding your right to privacy. Please refer to our Privacy Statement for details as to the manner in which CNIB collects, uses and discloses your personal information on the Discovery Portal.
LINKING
It is CNIB's goal to provide increased value to you, our visitors. Therefore, the Children's Discovery Portal may provide links and pointers to Internet sites that are owned operated and maintained by others and therefore are not affiliated with CNIB ("Third party sites"). Please understand that such Third party sites are independent from CNIB and that CNIB has no control over the content of such websites. Consequently, CNIB cannot be held liable and makes no warranty or representation whatsoever as to the accuracy, timeliness and/or completeness of the information contained therein.
The links which we might place on our Children's Discovery Portal do not imply that we sponsor, endorse or are affiliated or associated with, or have been legally authorized to use any trade-mark, trade name, service mark, design, logo, symbol or other copyrighted materials displayed on or accessible through such sites.
CNIB welcomes any feedback that you may have concerning the Third party sites that we have linked to our Children's Discovery Portal.
DISCLAIMER / LIMITATION OF LIABILITY
Use and browsing of the Children's Discovery Portal is at your sole risk. If you are dissatisfied with any of the information contained on the Children's Discovery Portal, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue accessing and using the Children's Discovery Portal. We do not warrant that the functions contained in the materials will be uninterrupted or error-free, and/or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the materials in this Children's Discovery Portal in terms of their correctness, accuracy, reliability, or otherwise. You (and not CNIB) assume the entire cost of all necessary servicing, repair or correction.
THIS CHILDREN'S DISCOVERY PORTAL INCLUDING THE CONTENT AND SERVICES PROVIDED HEREIN, IS BEING PROVIDED ON AN "AS IS" BASIS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AS SUCH, CNIB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, IN NO EVENT SHALL CNIB BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES THAT RESULT FROM OR IN CONNECTION WITH THE USE OF, OR THE INABILITY TO USE, THE CHILDREN'S DISCOVERY PORTAL OR ANY CONTENT OR SERVICES, HOWEVER SUCH DAMAGES ARE CAUSED AND WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY. THE FOREGOING LIMITATIONS SHALL APPLY WHETHER OR NOT CNIB, OUR AFFILIATES, LICENSORS, SUPPLIERS OR ANY OTHER PARTY INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THE CHILDREN'S DISCOVERY PORTAL HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You specifically acknowledge and agree that CNIB and/or our affiliates are not liable for any defamatory, offensive or illegal conduct of any user. We also assume no responsibility, and shall not be liable for any damages to, or viruses or other harmful components that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Children's Discovery Portal (including any bulletin board) or the server that makes it available, or your downloading of any information from the Children's Discovery Portal.
INDEMNITY
You are solely responsible for and agree to indemnify and hold harmless CNIB, its affiliates, members, officers, employees, agents and licensors from and against any and all losses, expenses, damages, claims, fines, penalties, costs and liabilities (including reasonable legal and accounting fees) resulting from (a) any content you (or anyone acting under your user name) submit, post, transmit, or make available on the Children's Discovery Portal and/or (b) your (or anyone acting under your user name) use of this Children's Discovery Portal, connection thereto, any alleged violation by you of these Terms of Use or any violation of the rights of another. CHANGES AND TERMINATION
CNIB reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Children's Discovery Portal (or any aspect or feature thereof), including without limitation content, hours of availability, and equipment required for access or use. Further, CNIB reserves the right to change these Terms of Use at any time and from time to time and to notify you by posting an updated version of the Terms of Use on this Children's Discovery Portal. You are responsible for regularly reviewing the Terms of Use, including, without limitation, by checking the date of "Last Update" at the bottom of this document. Continued use of the Children's Discovery Portal after any such changes shall constitute your consent to be bound by such changes, with continued provision of the use of the Children's Discovery Portal constituting consideration from CNIB to you for so being bound.
MISCELLANEOUS
This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, and the laws of Canada applicable therein, without giving effect to any principles of conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein.
